TERMS & CONDITIONS
Last updated: 25 October 2026
Welcome to Gelato Wholesale Collective. These Terms & Conditions ("Terms") govern your use of the website gelatowholesale.com (the "Site"), any orders placed through the Site, and any event bookings made with Gelato Wholesale Collective Pte Ltd ("GWC", "we", "our", "us").
By using the Site, placing an order, or booking an event with us, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. About us
Gelato Wholesale Collective Pte Ltd is a company incorporated in Singapore.
Company: Gelato Wholesale Collective Pte Ltd
2. Use of the Site
You may use the Site for lawful purposes only. You agree not to:
Use the Site in any way that is unlawful, fraudulent, or harmful
Attempt to gain unauthorized access to any part of the Site, our servers, or our data
Interfere with the Site's security or operation
Copy, reproduce, distribute, or use any content on the Site for commercial purposes without our written permission
We reserve the right to restrict or terminate your access to the Site at any time if we believe you have breached these Terms.
3. Content and intellectual property
All content on the Site — including text, images, logos, product descriptions, case studies, and recipe descriptions — is owned by GWC or used with permission, and is protected by Singapore and international intellectual property laws.
You may view and share content for personal or internal business reference. You may not reproduce, republish, or use any content commercially without our prior written consent.
The GWC name and logo are trademarks of Gelato Wholesale Collective Pte Ltd.
4. Product information and availability
We take care to describe our products accurately on the Site, including flavors, ingredients, formats, and halal certification status.
However:
Product availability may change without notice, especially for seasonal and limited-run flavors
Minor variations in color, texture, and taste may occur between production batches — this is normal for artisanal small-batch gelato
Images on the Site are illustrative; actual product appearance may vary slightly
Allergen information is provided in good faith based on our ingredient sourcing. If you or your guests have severe allergies, contact us directly to confirm current ingredient details before ordering
5. Online orders (Squarespace Commerce)
5.1 Placing an order When you place an order through our online shop, you are making an offer to purchase. We confirm acceptance of your order by sending you an order confirmation email. A contract is formed only when we send that confirmation.
5.2 Pricing All prices are in Singapore Dollars (SGD) and are inclusive of GST where applicable. We reserve the right to correct pricing errors; if a product is listed at an obviously incorrect price, we may cancel the order and refund you in full.
5.3 Payment Payment is processed via Squarespace Commerce and its third-party payment partners. We do not store your full card details. Your order is confirmed only once payment is successfully received.
5.4 Delivery Delivery details, timings, and fees are shown at checkout. We deliver islandwide in Singapore. Lead time is 1-2 working days.
Because our products are frozen and perishable, delivery arrangements require someone to receive the order at the time slot booked. If you are not available to receive the order and we are unable to arrange safe handover:
The order will be returned and re-delivery charged, or treated as a cancellation with no refund due to the product's perishability"
5.5 Returns and refunds Due to the perishable nature of our products, we do not accept returns of gelato, ice cream, popsicles, cakes, or premixes once delivered, except where:
The product is faulty, damaged, or materially different from what was ordered
The order was not delivered as agreed due to our error
In those cases, please contact us within 24 hours of delivery with photos and we will arrange a replacement, credit, or refund as appropriate.
Refunds are processed through the original payment method and typically arrive within 7–14 working days.
5.6 Cancellations Online orders may be cancelled before dispatch for a full refund. Once dispatched, the delivery policy above applies.
6. Wholesale and OEM supply
Wholesale, custom flavour development, and OEM / white-label production arrangements are governed by separate written agreements between you and GWC — not by these Terms alone. Those agreements will cover minimum orders, pricing, payment terms, lead times, confidentiality, intellectual property, and other commercial details specific to your arrangement.
If you have made a wholesale enquiry via the Site but no separate agreement has been signed, no supply obligation is created by the enquiry itself.
7. Event bookings
7.1 Making a booking Event bookings (corporate events, weddings, children's parties, activations, catering) are confirmed by:
Our written quote accepted by you in writing (email is sufficient), and
Payment of the agreed deposit
A booking is only confirmed once both are received. We reserve the right to decline bookings at our discretion.
7.2 Deposits and payment
A deposit of 50% of the event value is required to confirm your booking
The balance is due 2 days before the event date
Payment can be made by bank transfer, PayNow, or online payment as agreed
7.3 Changes to your booking Changes to event date, headcount, menu, or location must be requested in writing. We will do our best to accommodate changes, but:
Changes requested less than 3 days before the event may incur additional charges
Changes to custom flavors or bespoke popsicle moulds may not be possible after R&D or production has begun
7.4 Cancellation by the client If you cancel a confirmed event booking:
More than 30 days before the event — full refund of deposit, less any R&D or custom production costs already incurred
Between 30 and 14 days before — 50% of deposit refunded
Less than 14 days before — deposit is non-refundable
Less than 7 days before, or no-show — full event value is payable
These cancellation terms protect both parties — event bookings require us to commit staff, ingredients, custom moulds, and production time that cannot be redirected at short notice.
7.5 Cancellation by GWC In rare circumstances (illness, equipment failure, force majeure), we may need to cancel. In that case, we will refund all amounts paid, or offer to reschedule at no additional cost, at your election. We are not liable for consequential losses (venue costs, lost revenue, etc.) beyond the amounts you have paid us.
7.6 Force majeure Neither party is liable for failure to perform due to events beyond reasonable control — including natural disasters, government restrictions, public health emergencies, strikes, utility failures, or other force majeure events. In such cases we will work in good faith to reschedule.
7.7 Venue and setup You are responsible for:
Ensuring access to the venue at the agreed setup time
Providing suitable space, power supply (if required), and a flat surface for the cart
Any venue-specific permissions, licences, or insurance required at your venue
We bring our own equipment and public liability insurance for our team's work. If your venue requires a specific insurance certificate, let us know in advance.
7.8 Guest safety and allergens We will provide ingredient and allergen information on request. It is your responsibility to communicate this to your guests. We are not responsible for allergic reactions caused by failure to communicate allergen information to guests, or by guests consuming products containing allergens we have disclosed.
8. Custom flavour development and intellectual property
Where we develop a custom flavour, recipe, or product specifically for you (including under OEM / white-label arrangements):
The specific recipe developed for you is treated as confidential and we will not sell, share, or reuse it with other clients
Ownership of the recipe (full IP transfer vs. licensed use) will be agreed in a separate written agreement at the time of the project
Our general know-how, techniques, equipment, and base formulations remain our property
Any content, logos, or branding you provide for use on packaging remains your property; you grant us permission to use it solely for your project
9. Liability
To the extent permitted by law:
Our total liability to you for any claim arising from your use of the Site, products, or services is limited to the amount you have paid us for the specific product, order, or event giving rise to the claim
We are not liable for indirect, consequential, or incidental losses — including lost profits, lost opportunities, or reputational damage
Nothing in these Terms limits any liability that cannot be excluded under Singapore law (e.g. for death or personal injury caused by negligence, or for fraud)
10. Third-party links
Our Site may contain links to third-party websites (e.g. Instagram, delivery platforms, partner caterers). We are not responsible for the content, policies, or practices of those sites. Visiting those sites is at your own risk.
11. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top will be revised. Material changes to online order terms or event booking terms will apply to new orders and bookings made after the update — existing confirmed orders and bookings will be governed by the Terms in force at the time of booking.
12. Governing law and jurisdiction
These Terms are governed by the laws of Singapore. Any disputes arising from or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Singapore.
